Newsom Condemns Appeals Court Ruling on Trump’s Control of California National Guard

California Governor Gavin Newsom has sharply criticized the recent ruling by the 9th Circuit Court of Appeals that allows President Donald Trump to retain control of the California National Guard, saying the court rejected Trump’s claim of unchecked power.

In a post on X (formerly Twitter) early Friday morning, Newsom declared:

“The President is not a king and is not above the law.”


Newsom’s Statement: Court Rejected Trump’s Unlimited Power

While the appeals court extended Trump’s control of nearly 4,000 National Guard troops deployed to Los Angeles, Newsom emphasized that the court did not grant Trump unlimited authority. In his official statement, the governor said:

“The court rightly rejected Trump’s claim that he can do whatever he wants with the National Guard and not have to explain himself to a court.”


⚖️ Legal Battle Over Federalization of Troops Continues

Governor Newsom continues to challenge the federalization of the Guard, claiming it violates California’s sovereignty and is an authoritarian overreach. His lawsuit argues that:

  • Trump did not consult the state before activating the troops

  • The situation in Los Angeles protests did not amount to a ‘rebellion’

  • Federal troops should not be used for civilian law enforcement


What’s Next?

Despite the court allowing Trump to retain control for now, the ruling does not end the legal battle. Newsom vowed to “press forward” with efforts to challenge the deployment and possibly seek U.S. Supreme Court intervention.
